Cottlink Terms of Service

Cottlink (cottlink.com and the Cottlink Android app) is a business directory and blog with listings in Kenya and the USA. It is run by the Cottlink team in Nairobi, Kenya ("Cottlink", "we", "us"). These terms explain the rules for using Cottlink, creating an account and listing a business. By using Cottlink, you agree to these terms. If you do not agree, please do not use the site. Our Privacy Policy explains how we handle your personal data.

1. Who can use Cottlink

• You must be at least 18 years old to create an account or list a business.
• If you list a business, you must own it or be authorised to act for it.
• If you use Cottlink for a company or organisation, you confirm that you can accept these terms on its behalf.
• You must not use Cottlink if the law, or a previous suspension by us, prevents you from doing so.

2. Your account

• Give accurate details when you register, and keep them up to date.
• Keep your password private and use a strong, unique password. You are responsible for activity on your account.
• Tell us straight away at cottlink.tech@gmail.com if you think someone else has used your account.
• One person or business must not create multiple accounts to get around these terms or a suspension.

3. Listing accuracy

Listings are shown publicly so customers can find and contact you. When you create or update a listing, you agree that:

• the business name, category, location, contact details, opening hours and description are true and current;
• photos, logos and other uploads show your own business, work or products, and you have the right to use them;
• you will not list a business you do not own or represent, or copy another business's details;
• you will update or remove information that is no longer correct, such as a closed branch or changed phone number;
• any verification documents you submit are genuine.

If an existing listing belongs to your business, you can ask to claim it rather than creating a duplicate. We may edit listings to fix formatting, categories or obvious errors, and we may merge or remove duplicates.

4. Prohibited content and conduct

You must not use Cottlink to list, promote, post or do any of the following:

• Adult or sexual services of any kind, including services described as massage or companionship that are sexual in nature, and sexually explicit images or text.
• Scams, fraud, pyramid or "get rich quick" schemes, fake job offers, or requests for upfront "registration fees" in exchange for jobs or clients.
• Illegal goods or services, including drugs, weapons, counterfeit goods, stolen property and anything that breaks the law in Kenya or, for USA listings, the law where the business operates.
• False, misleading or impersonating information, including fake businesses, fake reviews or false claims of licences or qualifications.
• Content that is hateful, threatening, harassing or discriminatory, or that encourages violence.
• Content that infringes someone else's copyright, trademark or other rights.
• Spam, malware, or attempts to scrape, overload, hack or interfere with the site.
• Other people's personal data without their permission.

We may remove such content without notice and may report illegal activity to the authorities.

5. Packages and payments

Cottlink offers listing packages: Basic (free), Premium, Elite and Featured. What each package includes and its current price are shown on our pricing page. Prices and package features may change; the price shown when you pay is the price that applies to that purchase.

• Payments are processed by Paystack. We do not see or store your card or mobile-money details.
• A paid package applies to the listing and period stated at checkout. It is not transferable to another business unless we agree in writing.
• A paid package improves how your listing is presented. It does not guarantee a set number of views, calls, customers or a particular search ranking.
• If a payment fails or is reversed, we may return the listing to the Basic package.
• Refunds: package fees are non-refundable once your listing is live (active). If you pay and your listing never goes live, you will get a full refund. To request a refund, or if you think you were charged in error, contact cottlink.tech@gmail.com or 0704625414 with your payment reference.
• If we suspend or remove a listing for breaking these terms, we do not have to refund any package fees, except where the law requires it.

6. Reviews

• Reviews must reflect a genuine, first-hand experience with the business.
• Do not post reviews of your own business or a competitor's, and do not offer or accept payment or rewards for reviews.
• Reviews must not contain personal data, insults, threats or content banned under section 4.
• Businesses may reply to reviews politely. They must not pressure customers to change or remove reviews.
• We may remove reviews that break these rules. We do not remove honest negative reviews just because a business disagrees with them.

7. Intellectual property

The Cottlink name, logo, site design, software and the blog content we publish belong to us or our licensors. You may not copy, sell or reuse them without our permission, except to share links or short quotes with credit.

You keep ownership of the content you upload, such as your business description, photos and logo. By uploading it, you give us a non-exclusive, worldwide, royalty-free licence to host, display, resize and share it on Cottlink, in our app and in promotion of Cottlink (for example, in search results or social media posts about listed businesses). This licence ends when you delete the content, except for copies kept in backups for a short period or where we must keep them by law.

If you believe content on Cottlink infringes your rights, email cottlink.tech@gmail.com with details of the content and your claim, and we will review it.

8. Removal and suspension

We may, at our discretion and with or without notice:

• edit, hide or remove a listing, review, photo or other content;
• suspend or close an account;
• refuse a listing or verification request,

if we reasonably believe it breaks these terms or the law, is inaccurate, puts users at risk, or harms Cottlink's reputation. Where it is practical and safe, we will tell you why. If you think we made a mistake, email cottlink.tech@gmail.com and we will review it.

You can close your account at any time by following the steps in section 7 of our Privacy Policy.

9. Dealing with listed businesses

Cottlink is a directory. When you contact or hire a listed business, your agreement is with that business, not with us. We do not employ listed businesses, and we do not supervise, guarantee or take responsibility for their work, prices, products, safety or conduct, even if a listing has a verification badge or a paid package. Before you hire anyone, confirm the price, what is included and the timing, and check reviews. Never pay "registration fees" to people promising jobs or clients.

10. Disclaimers

Cottlink is provided "as is" and "as available". We work to keep the site accurate, secure and online, but we do not promise that it will always be available, error-free or free of harmful code, or that listings, reviews or blog content are complete or current. Blog articles are general information, not professional, legal, tax, financial or medical advice.

11. Limitation of liability

To the fullest extent the law allows:

• we are not liable for any loss or damage arising from your dealings with a listed business, or from content posted by other users;
• we are not liable for indirect or consequential losses, such as lost profits, lost business or lost data;
• if you use a free Basic listing, our total liability to you for any claim related to Cottlink is limited to the amount you paid us, which is zero; if you are a paid user, our total liability is capped at the package fees you paid us in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law. Nothing in these terms limits rights you have under Kenyan consumer protection law.

You agree to compensate us for reasonable losses and costs caused by your breach of these terms or by content you post.

12. Governing law and disputes

These terms are governed by the laws of Kenya. If a dispute arises, please contact us first so we can try to resolve it informally. If that does not work, the courts of Kenya will have jurisdiction, unless the law where you live gives you the right to bring a claim there.

13. Changes to these terms

We may update these terms. We'll change the "Last updated" date, and for major changes we'll post a notice on the site. If you keep using Cottlink after a change takes effect, you accept the updated terms.
